And, after the J&amp;K&#8217;s accession, popular leader <a href=\"https:\/\/rtiwala.com\/aipc-professionals-congress\/\" target=\"_blank\" rel=\"noopener noreferrer\">Sheikh Abdullah (grandfather or Omar Abdullah)<\/a> took over reins from Dogra ruler. In 1949, he negotiated J&amp;K&#8217;s political relationship with New Delhi, which led to the inclusion of\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Article_370\" target=\"_blank\" rel=\"noopener noreferrer\">Article 370<\/a>\u00a0in the Constitution.<\/p>\n<p style=\"text-align: justify;\"><script type=\"text\/javascript\" language=\"javascript\">\n      var aax_size='728x90';\n      var aax_pubname = 's707-21';\n      var aax_src='302';\n    <\/script><br \/>\n<script type=\"text\/javascript\" language=\"javascript\" src=\"http:\/\/c.amazon-adsystem.com\/aax2\/assoc.js\"><\/script><\/p>\n<p style=\"text-align: justify;\">The Article 35A inserted after the 1952 Delhi Agreement between Abdullah and Nehru, several provisions of the Constitution were extended to J&amp;K via the Presidential order of <a href=\"https:\/\/rtiwala.com\/mercy-petitions-rejected\/\" target=\"_blank\" rel=\"noopener noreferrer\">Dr Rajendra Prasad<\/a> in 1954.<\/p>\n<p style=\"text-align: justify;\"><strong>Also Read: <a href=\"https:\/\/cc.rti.link\/wa\" target=\"_blank\" rel=\"noopener noreferrer\">Interviews of Prominent Indian Personalities<\/a><\/strong><\/p>\n<h3 style=\"text-align: justify;\">The significance\u00a0of Article 35A for J&amp;K residents!<\/h3>\n<p style=\"text-align: justify;\">The <a href=\"https:\/\/cc.rti.link\/azd\" target=\"_blank\" rel=\"noopener noreferrer\">Constitution of Jammu &amp; Kashmir was framed in 1956<\/a>. It retained Maharaja Hari Singh&#8217;s definition of permanent residents:<\/p>\n<ul style=\"text-align: justify;\">\n<li>All persons born or settled within the state before 1911 or after having lawfully acquired immovable property resident in the state for not less than ten years prior to that date.<\/li>\n<li>All emigrants from Jammu and Kashmir, <a href=\"https:\/\/rtiwala.com\/arjan-singh-immortal-hero\/\" target=\"_blank\" rel=\"noopener noreferrer\">including those who migrated to Pakistan<\/a>, are considered state subjects.The descendants of emigrants are considered state subjects for two generations.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/cc.rti.link\/azd\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" style=\"border: 0px;\" src=\"http:\/\/resources.hostgator.in\/affiliate\/wp_728x90.gif\" alt=\"\" width=\"728\" height=\"90\" \/><\/a><\/p>\n<ul style=\"text-align: justify;\">\n<li>The passed\u00a0<em><strong>Permanent Residents law prohibits non-permanent residents<\/strong><\/em> (from other states of India) to get a permanent settlement in the state of J&amp;K, acquiring immovable property, govt jobs, scholarships, and aid.<\/li>\n<li>It was also interpreted as discriminatory against J&amp;K women. It disqualified them from their state subject rights if they married non-permanent residents.<\/li>\n<\/ul>\n<blockquote><p>But, in a landmark <a href=\"https:\/\/timesofindia.indiatimes.com\/india\/article-35a-and-its-significance\/articleshow\/59968712.cms\" target=\"_blank\" rel=\"noopener noreferrer\">judgment in October 2002<\/a>, J&amp;K high court held that women married to non-permanent residents will not lose their rights. The children of such women don&#8217;t have succession rights.<\/p><\/blockquote>\n<ul style=\"text-align: justify;\">\n<li>An emergency can be imposed only on the grounds of internal disturbances and imminent danger from<br \/>\na foreign enemy.<\/li>\n<li>The central government has <a href=\"https:\/\/cc.rti.link\/azd\" target=\"_blank\" rel=\"noopener noreferrer\">no power to impose financial emergenc<\/a>y in the state.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Watch Now: <a href=\"https:\/\/cc.rti.link\/wa\" target=\"_blank\" rel=\"noopener noreferrer\">RTIwala TV<\/a><\/strong><\/p>\n<h4 style=\"text-align: justify;\">All of sudden why Article 35A is trending?<\/h4>\n<p style=\"text-align: justify;\">Today the Hon&#8217;ble Supreme Court is set to take up a clutch of petitions challenging the constitutional validity of the politically contentious Article 35A. Four petitions demanding to scrap of the provision have been listed before a <a href=\"https:\/\/www.livelaw.in\/cji-dipak-misra-justices-nariman-chandachud-kahnwilkar-and-indu-malhotra-to-hear-s-377-casea\" target=\"_blank\" rel=\"noopener noreferrer\">bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandracud.<\/a> The main petition was filed by Delhi-based NGO We the Citizens in 2014.
