How to File RTI Online for Bihar by RTIwala team

How to File RTI in Bihar

Right to Information (RTI) is a legal tool that allows you to demand information from government offices in Bihar – from block offices, police stations, municipal bodies, schools, health departments to state secretariat and more. Under the RTI Act, 2005, most public authorities in Bihar must reply within 30 days of receiving your application.rti.gov.in

In Bihar, you can file RTI in three practical ways:

  1. Online through the Bihar RTI / “Jaankari” system
  2. Offline (physical application by post or in person)
  3. Online through RTIwala (including Anonymous RTI)

Below is an in-depth, practical guide on all three.

2.1 Filing RTI Online in Bihar

Online filing is convenient if you’re comfortable with portals and digital payments and know exactly which department/PIO holds the information.

2.1.1 Steps to File RTI Online through Bihar State RTI Portal

Bihar was one of the first states in India to innovate with RTI by launching “Jaankari”, a dedicated RTI facilitation system (call centre + online portal) for citizens. Initially, citizens could dial 155311 and get RTI drafted and sent to the concerned PIO; this has now been expanded to an online RTI filing system.Sheikhpura District

Most district/nic sites of Bihar link to the state RTI system, often available via:

  • The Bihar RTI / Jaankari website (linked from district sites)Sheikhpura District
  • The state services portal that hosts e-services for citizens (serviceonline.bihar.gov.in / biharonline.gov.in etc.)serviceonline.bihar.gov.in

The exact UI may vary slightly, but the flow is broadly like this:

Step 1 – Visit the Bihar RTI / Online Services Portal

  1. Go to your district website (e.g., sheikhpura.nic.in, patna.nic.in) → “सूचना का अधिकार / RTI” section.
  2. Click the link for “आरटीआई फ़ाइल के लिए यहां क्लिक करें (राज्य सरकार – बिहार)”, which redirects you to the Bihar RTI / Jaankari portal.Sheikhpura District
  3. Alternatively, you may find a service titled “Apply for Right to Information (RTI) Application – Bihar” under the central services directory.India Government Services

Tip: Always check the URL is a government domain like *.bihar.gov.in or *.nic.in for safety and authenticity.

Step 2 – Register or Login

  • New users typically need to register:
    • Name
    • Mobile number & email
    • Address and district
  • Existing users can log in with username/mobile and password.

Many state portals follow a structure similar to RTPS/ServiceOnline, where you use a common login for multiple citizen services.serviceonline.bihar.gov.in

Step 3 – Choose “RTI Application” Service

Once logged in:

  1. Go to “Apply Online” / “Services”.
  2. Search or browse for “Right to Information (RTI) Application” for the relevant department.India Government Services

Some systems ask you to:

  • Select Department (e.g., Education, Rural Development, Police, Urban Development).
  • Select Office / Public Authority (e.g., Block Development Office, District Education Office, Police Station, Municipal Corporation).

Step 4 – Fill the RTI Application Form

Typical fields you must fill:

  • Applicant details:
Full name, postal address, contact number, email.
  • Public Authority / Office:
The specific department & office holding the information.
  • Subject / Title:
A short heading like “Information regarding delay in mutation of land records in XYZ Mauza, District Patna”.
  • Description of Information Sought:
Clearly list your questions in numbered points:
    • Avoid long stories, focus on “What documents / records / data you want”.
    • Ask for certified copies, file notings, orders, inspection, etc.
  • Mode of receiving information:
Usually “by post” or “by email + post”.

Legal Note: Under Bihar RTI Rules and RTI Act, the application fee is ₹10, and additional charges apply per page (typically ₹2 per A4/A3 page, plus actual cost for larger formats or CDs). BPL applicants are exempt from the application fee but must attach proof.righttoinformation.wiki

Step 5 – Attach Supporting Documents (If Needed)

  • Not mandatory, but you may upload:
    • Copy of earlier complaints / representations
    • Proof of BPL status (if seeking fee exemption)
    • Relevant notices, orders, receipts etc.

Don’t attach identity proofs unless absolutely necessary; RTI is a right, not a “favor”.

Step 6 – Pay RTI Application Fee Online

As per Bihar RTI Rules, the application fee is ₹10 per RTI application (some authorities interpret it “per query”; safest is to keep questions logically related).righttoinformation.wiki

Payment modes can include (depending on the portal):

  • Net banking
  • Debit/Credit card
  • UPI or wallet
  • Other payment gateway options as enabled by the state.India Government Services

Once payment is successful:

  • You receive an Application Number / Acknowledgment.
  • You can track status from the portal’s “View Status” / “Track Application” section.

Step 7 – Track Status & Keep Copies

  • Download / save the acknowledgment PDF and payment receipt.
  • Note that the Public Information Officer (PIO) must reply within 30 days (48 hours in life & liberty cases).rtiguru.com

If no reply or an unsatisfactory reply is received, you can file:

  • First Appeal to the First Appellate Authority (FAA) of that department.
  • Second Appeal to the Bihar Information Commission, Patna.sic.bihar.gov.in

2.1.2 RTI Filing Using RTIwala Portal (Online Option)

If the Bihar portal is confusing, often down, or you’re unsure about drafting, you can still file RTI for Bihar departments online using RTIwala’s platform.

At a high level, RTIwala:

  • Provides done-for-you drafting based on your facts.
  • Identifies the most appropriate public authority & PIO in Bihar.
  • Prints, signs, pays government fees, and dispatches your RTI physically or via the accepted mode to the concerned office.
  • Tracks the matter and guides you on First Appeal / Second Appeal if required.

This option is covered in detail in Section 2.3 below.

2.2 Filing RTI Offline in Bihar

Many sensitive or local issues in Bihar (land records, police complaints, municipal works, ration cards, etc.) are still best handled through offline RTI, especially when:

  • The department doesn’t appear clearly on the state portal.
  • The portal is not functioning properly.
  • You want full control over wording, annexures, and dispatch.

2.2.1 Steps for Filing a Physical RTI Application in Bihar

Step 1 – Identify the Correct Public Authority & PIO

You must address your RTI to the:

“Public Information Officer (PIO)”
[Name of Department / Office]
[Full Postal Address]
[District], Bihar – PIN

You can find RTI contacts:

  • On the department’s Bihar government site (*.bihar.gov.in / *.nic.in).Bihar State Government
  • From district RTI pages (e.g., Patna’s RTI section lists key offices and contact details).Patna District
  • Via calls or visits to the office asking specifically for PIO name & designation.

If unsure, RTIwala can help identify the correct authority as part of its drafting process.

Step 2 – Draft a Clear RTI Application

Write your application in English or Hindi (or the official language accepted by that office). Format:

  1. Applicant details: Name, full postal address, mobile, email.
  2. To: PIO of the concerned department in Bihar.
  3. Subject: “Application under the Right to Information Act, 2005 regarding …”
  4. Reference (optional): Mention any previous complaint/letter date & number.
  5. Information sought (numbered):
    • Each question should ask for records, copies, data, reports, file notings, rules, circulars etc.
    • Avoid opinions, explanations like “why did you delay…” – instead ask:
      • “Provide certified copies of the noting sheet…”
      • “Provide date-wise action taken details on my complaint dated…”, etc.
  6. Fee clause: Mention you are enclosing the ₹10 application fee through IPO/DD/court-fee stamp as per Bihar RTI Rules.righttoinformation.wiki
  7. BPL clause (if applicable):
    • “I am a BPL card holder; kindly exempt me from application fee as per RTI Act/Bihar RTI Rules. BPL copy enclosed.”rtiguru.com
  8. Declaration & signature: Date, place, signature with name.

Step 3 – Attach the Correct RTI Fee

As per Bihar RTI Rules, 2006 (as amended):righttoinformation.wiki

  • Application fee: ₹10
    • Payable via:
      • Indian Postal Order (IPO)
      • Demand Draft / Banker’s Cheque
      • Court fee stamp
      • Cash against proper receipt (when filing in person)
  • Further fees (if information is bulky):
    • ₹2 per A4/A3 page
    • Actual cost for larger paper or maps
    • ₹50 per CD/floppy
    • Inspection charges (e.g., ₹10 for first hour, then ₹5 per 15 minutes, depending on department’s RTI rules).righttoinformation.wiki

Attach:

  • IPO/DD with payee “PIO, [Department Name]” (or as specified by that office).
  • Or affix ₹10 court fee stamp on the application where accepted.

Step 4 – Submit the RTI

You have two options:

  1. In person:
    • Visit the office and give RTI to the Receipt section or direct PIO.
    • Always insist on a sealed/stamped acknowledgment with date and diary number on your copy.
  2. By Registered Post / Speed Post:
    • Send to the PIO with all enclosures.
    • Keep the postal receipt safely; it is proof of dispatch and date.

Important: The 30-day reply time is counted from the date the RTI reaches the office (date of receipt, not dispatch).rtiguru.com

Step 5 – Follow-up & Appeal

If:

  • No reply within 30 days, or
  • Information is denied / incomplete / misleading,

you can file a First Appeal to the First Appellate Authority (FAA) in that department. If still unsatisfied, you can go to the Bihar Information Commission, which is headquartered at Soochna Bhawan, Nehru Marg, Patna.sic.bihar.gov.in

2.2.2 Documents Required for Offline RTI Filing

Usually no heavy documentation is required. Typically:

  • Mandatory:
    • RTI application (signed)
    • RTI fee (IPO/DD/court fee stamp/cash receipt)
  • Optional but useful:
    • Copies of prior complaints/letters
    • Copies of orders/notices you are referring to
    • BPL certificate (for fee waiver)
    • Any proof that the matter concerns you (for practical handling, though RTI is not restricted only to “affected parties”).

2.3 Filing RTI through RTIwala Portal (Recommended for Most Users)

If you:

  • Are not confident about legal drafting,
  • Don’t know which department/PIO in Bihar to target,
  • Want to avoid using personal details due to fear of harassment,
  • Or simply don’t have time to handle printing, DD/IPO, speed post, and tracking,

then filing RTI through RTIwala becomes a strong, low-risk option.

2.3.1 RTIwala Overview and Benefits

RTIwala is a specialized RTI assistance platform that:

  • Researches your case and identifies the correct Bihar department & PIO.
  • Drafts RTI in professional legal language, focusing on documents, file notings, circulars, orders, and action-taken reports.
  • Manages fee payment, printing, signatures, dispatch (Speed Post/Registered Post or as per rules).
  • Tracks the case and helps with First Appeal / Follow-up if:
    • No reply,
    • Delayed reply,
    • Vague or denial of information.

Key benefits for Bihar applicants:

  1. Error-free drafting → lower chances of rejection on technical grounds.
  2. Correct authority mapping → RTI reaches the right PIO in Bihar.
  3. End-to-end handling → you don’t need to handle stamps, IPO, or complex portals.
  4. Guidance on appeals → if PIO misuses exemptions or delays, you’re not stuck.

2.3.2 Anonymous RTI Service of RTIwala (For Sensitive Bihar Issues)

Many citizens in Bihar hesitate to file RTI due to:

  • Local power dynamics (panchayat, land mafia, ration shop, police station).
  • Fear of retaliation, harassment, or social pressure.
  • Concern that their name and address will be known to influential persons.

RTIwala’s Anonymous RTI service is designed specifically to handle such cases more safely:

  • Your personal details are not used in the filed RTI.
  • RTIwala (or its authorized associate/applicant) files the RTI from its own side, based on information you provide.
  • You share the facts & documents privately; RTIwala uses them to draft smart, document-demanding queries that can expose:
    • Fund misuse
    • Illegal construction
    • Irregularities in schemes
    • Police inaction, etc.
  • You still receive a copy of the filed RTI, tracking details, and replies (wherever legally feasible).

This doesn’t “change the law” – RTI is still filed as per RTI Act, 2005 & Bihar RTI Rules – but your identity remains in the background, making it safer to raise uncomfortable questions.

For high-risk issues (corruption, land, local politics, police matters), Anonymous RTI via RTIwala can be much safer than filing directly in your own name at a nearby office.

2.3.3 Detailed Steps for RTI Filing via RTIwala (for Bihar Cases)

The exact UI and flow may differ slightly, but a typical RTIwala Bihar filing journey looks like this:

Step 1 – Choose RTI Service on RTIwala Website

  • Visit RTIwala’s website.
  • Select the relevant service:
    • Standard RTI filing for Bihar, or
    • Anonymous RTI (recommended for sensitive matters).

Step 2 – Share Basic Case Details

You’ll be asked to fill a simple, guided form:

  • Your contact details (for RTIwala to send drafts & updates).
  • State: Bihar
  • Department type: Revenue/Land, Police, Urban/Rural Development, Education, Health, Electricity, etc.
  • Short description like:
    • “Mutation of land not done despite application in X year”
    • “Illegal construction/encroachment on government land in XYZ area”
    • “No action on written complaint at police station”
  • Upload any supporting documents (complaints, receipts, photos, orders).

You can also mention if you want:

  • RTI in your own name, or
  • Anonymous RTI, where RTIwala uses its own/associate details.

Step 3 – Expert Drafting & Authority Mapping

Behind the scenes, RTIwala’s team:

  1. Identifies the correct Bihar public authority & PIO (e.g., Circle Officer, BDO, SHO, DM office, Municipal Commissioner, departmental head, etc.).
  2. Prepares a precise RTI draft that:
    • Avoids emotional language.
    • Frames each point as a clear information request (documents, records, file notings).
    • Cites relevant RTI provisions if needed (to avoid wrongful denial).

You typically receive:

  • A preview of the draft for your review, or
  • Confirmation that RTI has been prepared and is ready to be filed.

Step 4 – Filing & Payment of Government Fees

RTIwala then:

  • Pays the ₹10 application fee in the mode accepted by that Bihar authority (IPO, DD, court fee stamp, etc.).righttoinformation.wiki
  • Prints and signs the RTI (in its own or designated applicant’s name, if Anonymous RTI).
  • Sends it via Speed Post / Registered Post / other accepted method to the correct PIO address.

You are provided with:

  • Proof of filing (copy of RTI, postal receipt, etc.).
  • Tracking ID (where applicable) so you can monitor delivery.

Step 5 – Tracking Replies & Next Steps

Once the PIO replies:

  • RTIwala receives the official reply and shares it with you (scan / summary).
  • If:
    • No reply in 30 days, or
    • Reply is vague/incomplete/illegal refusal,
    RTIwala can assist in:
    • Drafting and filing First Appeal to the competent FAA in Bihar.
    • Suggesting strategy for Second Appeal to Bihar Information Commission, if needed.

3. First Appeal Process

3.1 What is a First Appeal?

Under the Right to Information Act, 2005, a First Appeal is the second step you can take if your original RTI doesn’t get a proper response.

Legally, Section 19(1) of the RTI Act says that if:

  • you don’t receive any reply from the Public Information Officer (PIO) within the prescribed time, or
  • you receive a reply but are not satisfied (incomplete, misleading, wrongly rejected, or excess fees demanded),

you can file an appeal before an officer who is senior in rank to the PIO in the same department. This officer is called the First Appellate Authority (FAA). Indian Kanoon

In simple words:

First Appeal = a formal complaint to the senior officer of the same department, asking them to review what the PIO did (or failed to do) and to direct that proper information be given.

You are not required to hire a lawyer. The process is designed to be citizen-friendly, and you can write the appeal yourself in clear language.

You can file a First Appeal in cases like:

  • No reply within 30 days (or extended time where applicable)
  • Only partial information given
  • Information denied without valid reason
  • Excessive fees demanded
  • Information given in wrong format despite your specific request
  • PIO misinterprets your query or gives irrelevant documents

3.2 When and How to File a First Appeal

When should you file?

Section 19(1) lays down the timelines: Indian Kanoon

  1. If no reply from PIO:
    • You can file a First Appeal after 30 days from the date the PIO received your RTI application.
    • Example: If your RTI was received on 1st March, and you get no reply, you can file First Appeal from 2nd April onward.
  2. If you received an unsatisfactory reply:
    • You must file the First Appeal within 30 days from the date you received the PIO’s reply.
  3. If third-party interest is involved (rare for normal users):
    • Timelines may vary slightly, but the same Section 19(1) logic applies – 30 days from decision or from expiry of the time limit.

The FAA also has the power to condone delay (accept a late appeal) if you give a valid reason (illness, travel, not aware of reply date, etc.). Indian Kanoon

How should you file? (General structure)

Your First Appeal should clearly mention:

  • Your name, address, mobile/email

3.3 Procedure for Filing a First Appeal in Bihar

In Bihar, you can file a First Appeal in two main ways:

  1. Offline (physical appeal letter)
  2. Online (through Bihar’s RTI-related services)

(A) Offline First Appeal in Bihar

For state government departments in Bihar, the Bihar Right to Information Rules, 2005 apply. These rules also talk about procedures and fee for appeals.rtifoundationofindia.com

Step 1: Identify the correct First Appellate Authority (FAA)

  • Check the RTI section on the website of the concerned department/district.
  • Many Bihar government websites and district portals publish lists of PIOs and First Appellate Authorities.Patna District
  • Often, the FAA’s name and designation are mentioned at the bottom of the PIO’s reply.

Step 2: Draft your First Appeal

Use a simple format covering:

  • To
    • Name, Designation of FAA
    • Name of Department / Office
    • Address
  • Subject:
    • “First Appeal under Section 19(1) of RTI Act, 2005 – [brief on subject]”
  • Body of appeal:
    • Your details
    • RTI application details (date, subject, application number)
    • Facts of the case (no reply / incomplete reply / wrong denial etc.)
    • Grounds for appeal
    • Relief requested

Step 3: Pay the First Appeal Fee (for Bihar State Authorities)

Unlike the Central RTI system (where first appeal is free), the Bihar RTI Rules, 2005 specify that the Appellate Authority shall charge a fee of Rs. 50 per appeal for state public authorities.rtifoundationofindia.com

  • Mode of payment can vary by department, for example:
    • Court fee stamp
    • Treasury challan
    • Demand draft / banker’s cheque
  • Always check the RTI/Fee section of that particular Bihar department’s website or their RTI manual for exact payment mode.brpnnl.bihar.gov.in

Note: For Central Government offices located in Bihar (like Railways, Income Tax, etc.) and some bodies like Patna High Court, there is no fee for first appeal as per RTI Act and Central guidelines.Patna High Court

Step 4: Attach supporting documents

  • Copy of original RTI application
  • Copy of PIO’s reply (if any)
  • Proof of submission / postal receipts
  • Any other relevant documents

Step 5: Submit and keep proof

  • Submit in person and take a receiving copy with seal & date, or
  • Send via Registered Post / Speed Post and keep the postal receipt + tracking report printout.

These documents will be crucial if you later need to go for a Second Appeal before the Bihar Information Commission.sic.bihar.gov.in

(B) Online First Appeal in Bihar

Bihar provides online RTI services through state e-governance portals and RTI-related services where citizens can file a First Appeal digitally for certain departments.India Government Services

Typical steps:

  1. Visit the Bihar RTI/Appeal service page (e.g., “Apply for RTI 1st Appeal, Bihar”). India Government Services
  2. Login / register (if required).
  3. Select the department and enter:
    • Original RTI application number
    • Date of filing
    • Details of PIO reply (or mark “no reply received”)
  4. Fill in the grounds and relief part similar to the offline appeal.
  5. Upload scanned copies of your RTI application, PIO reply, and other documents.
  6. Pay applicable appeal fee (if required for that authority) using online payment modes, if the rules demand it.
  7. Submit and download / note the Appeal Reference Number for tracking.

3.4 Time Limits for First Appeal

There are two separate time limits you must remember:

(A) Time limit for filing the First Appeal

  • You should file the First Appeal within 30 days: Indian Kanoon
    • from the date you received the PIO’s reply, or
    • from the date the PIO’s reply should have been received (normally 30 days after PIO got your RTI).

If you missed this 30-day limit, don’t panic. The FAA can accept a delayed appeal if you show “sufficient cause” (illness, late delivery of reply, etc.).Indian Kanoon

(B) Time limit for disposal of First Appeal

  • Section 19(6) of the RTI Act says:
    • The First Appeal must be decided within 30 days of receipt, or
    • Within a maximum of 45 days, but only if there are valid reasons recorded in writing.Indian Kanoon

That means:

Legally, the FAA should give you a written order within 30–45 days from the date your appeal reaches their office.

If you still don’t get any order, or the order is unsatisfactory, you can move to Second Appeal / Complaint before the Bihar Information Commission within 90 days.rtifoundationofindia.com

3.5 Response Time for First Appeal & What to Expect

How long will it take?

  • Ideal: Within 30 days of the FAA receiving your appeal.
  • Maximum (with reasons recorded): 45 days from the date of filing.Indian Kanoon

In its order, the First Appellate Authority may:

  • Direct the PIO to provide full information
  • Ask the PIO to correct the format or provide certified copies
  • Uphold the PIO’s decision (if the denial was valid under an exemption)
  • Recommend steps to improve record-keeping or RTI handling inside the department

What if the FAA also delays or gives a poor order?

If:

  • No order is received from the FAA within 45 days, or
  • You receive an order but the information is still withheld / incomplete / unjustly denied,

then you can:

  1. File a Second Appeal before the Bihar Information Commission (BIC) within 90 days, or
  2. File an RTI-based Complaint to the BIC pointing out non-compliance or misconduct by the PIO.rtifoundationofindia.com

The State Information Commission has powers to:

  • Order disclosure of information
  • Award compensation to you in appropriate cases
  • Impose penalty up to Rs 25,000 on the PIO for unreasonable denial, delay, or destruction of information (Section 20). DGR India

4. Departments and Areas to File RTI in Bihar

Right to Information in Bihar can be used for almost every government office – from the Chief Minister’s Secretariat to your local block office or police station. The key is to know which department holds the information you need.

Below is a detailed guide to help you identify where to file an RTI in Bihar, depending on your issue.

4.1 General Overview of Departments

In Bihar, RTI applications can be filed to:

  • Bihar State Government Departments – Ministries, Directorates, and their field offices
  • Local Bodies – Municipal Corporations, Municipal Councils, Nagar Panchayats, Gram Panchayats
  • Police & Home Department – Police Stations, District SP Offices, Home (Police) Department
  • Education Bodies – Government schools, colleges, universities, examination boards
  • Health Institutions – Government hospitals, CHCs, PHCs, State Health Department, NHM Bihar
  • Infrastructure Departments – PWD, Rural Works, Urban Development and Housing
  • Sectoral Departments – Agriculture, Energy, Water Resources, Social Welfare, Food & Civil Supplies, etc.
  • Legislative Bodies – Bihar Vidhan Sabha and related secretariat
  • Other Statutory / Government Bodies – Development authorities, corporations, boards, commissions

Important point:
RTI must always be filed with the Public Information Officer (PIO) of the concerned department/office which holds the records – not randomly to “the Government of Bihar” as a whole. If you are unsure, you can still file to any likely PIO; by law, they must transfer your RTI under Section 6(3) to the correct office if needed.

4.2 Specific Departments and Authorities to File RTI

Below are the major areas where citizens usually need information, and where to file RTI for each.

4.2.1 Bihar State Government (Secretariat & Departments)

If your matter is about state-level policy, schemes, circulars, recruitment rules, transfers, budget, sanctions, or state-wide data, the concerned Department at the Bihar Secretariat, Patna is usually the right place.

Common departments include (non-exhaustive list):

  • General Administration Department (GAD) – cadre rules, reservations, service matters of state employees, departmental circulars.
  • Finance Department – state budget, funds allocation, financial sanctions, grants to departments.
  • Rural Development Department – MGNREGA implementation, rural schemes, panchayat development projects.

  • Traffic fines, challan statistics, accident data, and action taken on specific violations.
  • Police station manpower, sanctioned vs. working strength, jurisdiction details.

5. Top 20 PIOs (Public Information Officers) in Bihar

A large number of RTI applications in Bihar revolve around public grievances, land matters, police actions, local governance, and welfare schemes. Because of this, some PIO offices receive thousands of RTI applications every year, making them the most frequently approached authorities in the state.

This section gives you a detailed, user-focused guide on the top PIOs, why they receive the highest number of RTIs, and what their role is.

5.1 Most Commonly Filed PIOs in Bihar

Certain departments in Bihar handle high-impact public services, such as land records, policing, education, electricity supply, welfare schemes, and infrastructure.
These areas often involve delays, lack of transparency, missing documents, or improper updates, which motivates citizens to file RTI applications.

Why These PIOs Receive Maximum RTI Requests

1️⃣ Critical Public Services

PIOs in departments like Electricity, Police, Municipal Corporations, Education, and Health deal with essential day-to-day services. Any delay or mistake directly affects citizens, increasing RTIs.

2️⃣ Land and Property Issues Are Very Common

In Bihar, land disputes are frequent. So RTIs related to:

  • Jamabandi,
  • Mutation,
  • Khasra-Khatauni,
  • Encroachment complaints,
  • Land map copies
are heavily filed with Revenue & Land Reforms Department and Circle Offices.

3️⃣ Welfare Scheme Irregularities

From pension to ration to MGNREGA, people file RTIs when:

  • their names don’t appear in beneficiary lists,
  • payments are delayed,
  • funds are misused.
So PIOs under Social Welfare, Food & Civil Supplies, Rural Development get many RTIs.

4️⃣ Police Inaction or FIR-Based Queries

Cases like:

  • non-registration of FIR,
  • no action taken,
  • late investigation,
  • wrong charges added
make Police PIOs some of the most contacted officers.

5️⃣ Education Sector Complaints

Recruitment, transfers, pay scale approval (HSP), answer sheet copies, scholarship delays—these generate thousands of applications yearly with Bihar Education Department PIOs.

6️⃣ Lack of Online Access to Records

Many departments have incomplete or outdated websites. Citizens file RTIs because they can’t access clear information online.

6.3 Role of These Authorities in Bihar’s RTI System

These top authorities play three crucial roles in the RTI ecosystem:

1. Public Information Handling (Primary Role)

Each authority designates:

  • Public Information Officer (PIO)
  • Assistant PIO (APIO)
  • First Appellate Authority (FAA)

Their responsibility is to:

  • Accept RTI applications
  • Maintain departmental records
  • Provide information within 30 days
  • Justify exemptions under Section 8 (if any)
  • Ensure timely action on appeals

Departments like GAD, Home, Education, and Health receive the highest number of RTI queries in Bihar.

2. Transparency & Record Management

These authorities maintain:

  • Administrative records
  • Service books
  • Departmental orders
  • Scheme progress reports
  • Financial audits
  • Tender documents
  • Public expenditure records

Under Section 4 of RTI Act, they must suo motu publish:

  • Organization structure
  • Scheme details
  • Service delivery norms
  • Budget allocations
  • Contact details of PIOs

However, compliance levels vary, and many departments in Bihar still do not update Section 4 disclosures regularly—making RTI a necessary tool for citizens.

3. Grievance Redressal & Accountability

When citizens file RTI applications related to:

  • corruption,
  • delayed services,
  • land disputes,
  • welfare scheme targeting,
  • recruitment irregularities, or
  • missing records,

these top authorities become directly accountable for corrective action.

The State Information Commission (SIC) acts as the watchdog and can impose penalties on officers under Section 20.
